Speeding Car With Unrestrained 2 Year Old, Driver Cited For DUI, Child Abuse

Around 12:30 a.m. Wednesday, Lincoln police saw a vehicle near 1st and Cornhusker that made an improper turn without a turn signal and was then seen weaving in and out of traffic.  The officer estimated the vehicle was going about 20 mph over the speed limit.

The officer initiated a traffic stop and immediately noticed a 2 year old unrestrained in the back seat of the vehicle.  The driver, 32-year-old David Milage showed signs of impairment and reported being the child’s legal guardian.  The driver failed field sobriety tests and was taken into custody.  Mileage was also found to have an active misdemeanor warrant.  Upon checking Mileage’s current license status, it was discovered he had a suspended license.

The child was taken into temporary protective custody until a suitable caregiver could be located.

Mileage was formally tested for his alcohol level at approximately 2 a.m. and was found to be a .112g of alcohol per 210 L of breath.  Mileage was arrested for Child Abuse, Driving under the Influence with a Passenger under 16 years old, Failure to Restrain Child in Vehicle, Driving During Suspension, Fail to Signal, and Improper Turn.  Mileage was also arrested on the outstanding warrant.
